Agreement

By accessing or using twinklegear.com ("the Site") or purchasing products from TwinkleGear, an assumed business name of Josh Preston, sole proprietor ("TwinkleGear," "we," "us"), you agree to these Terms of Service.

Products and Services

TwinkleGear is a print-on-demand retail e-commerce store. Products are custom-made to order.

Orders

• All orders are subject to availability and confirmation
• Prices are displayed in USD and may change without notice
• We reserve the right to refuse or cancel any order
• Order confirmation does not constitute acceptance — acceptance occurs when the item ships

Payment

• Payment is required at the time of purchase
• We accept payment via Stripe (credit/debit cards and other methods supported by Stripe)
• Prices are shown exclusive of sales tax. Any applicable sales tax is calculated and added at checkout based on your shipping address

Shipping

• Products are made to order and shipping times vary
• Estimated delivery times are not guaranteed
• We are not responsible for delays caused by carriers or customs
• Risk of loss passes to the buyer upon delivery to the carrier

Returns and Refunds

Every physical item is printed to order specifically for you, so we cannot accept returns or exchanges for size, fit, colour preference, or change of mind. Please check the size guide before ordering.

• We will replace or refund any item that arrives damaged, defective, misprinted, or materially different from what was ordered — at no cost to you
• Report the issue within 30 days of delivery, with photos. Please do not ship anything back unless we ask you to
• If a parcel is lost in transit, tell us as soon as possible — claims must be raised within 30 days of the estimated delivery date
• If an order cannot be delivered because of an incorrect address supplied at checkout, reshipment is at your cost
• Orders enter production almost immediately after payment, so we usually cannot cancel or change an order once placed. Contact us straight away and we will cancel and refund in full if production has not started

Twinkles, Sparkles, and TwinkleTown

TwinkleGear includes digital collectible characters (“Twinkles”) and an in-app currency (“Sparkles”, ✦). These terms govern them.

• All sales of digital items are final. Opening a Mystery Box, fusing Sparkles, and buying a Twinkle in TwinkleTown are completed immediately and cannot be refunded, reversed, or exchanged
• Sparkles have no cash value. They cannot be purchased with money, redeemed for money, withdrawn, or exchanged for anything outside TwinkleGear. They are not currency, credit, a gift card, stored value, a security, or a token of any kind
• Twinkles and Sparkles are a limited, personal, revocable licence to use digital content within TwinkleGear. You do not own them as property, and they are not NFTs, crypto assets, or investments
• Mystery Boxes contain a randomly selected Twinkle. Published odds reflect the actual selection weights used by our systems. A Twinkle is a digital collectible — it is not a physical product, and it does not entitle you to free or discounted merchandise
• Selling, buying, or transferring Twinkles, Sparkles, or accounts for real money outside TwinkleGear is prohibited. We may reverse affected transactions, remove items, and suspend accounts involved
• We may change, suspend, or discontinue Mystery Box odds, prices, Sparkle earn rates, TwinkleTown, or any digital item. Changes apply going forward, not retroactively
• Sparkles do not expire while your account is open and in good standing
• If your account is closed for breach of these terms, or a purchase is charged back, any associated Sparkles and Twinkles may be forfeited without refund
• If we discontinue the service, we will give reasonable notice and a period in which to use any remaining Sparkle balance. Sparkles will not be exchanged for money
• TwinkleTown transactions are between collectors and settle in Sparkles only. We provide the venue; we are not the buyer or seller and do not guarantee any listing
• You must be 18 or older, or have the permission of a parent or guardian, to buy a Mystery Box or use TwinkleTown

Intellectual Property

• The TwinkleGear name, logo, designs, and website content are property of TwinkleGear
• You may not reproduce, distribute, or create derivative works from our content without written permission

User Conduct

• You agree not to use the site for any unlawful purpose
• You agree not to attempt to interfere with the site's operation
• You agree not to submit false information or use automated tools to access the site

Limitation of Liability

To the maximum extent permitted by law, TwinkleGear shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or products.

Disclaimer

Products and the site are provided "as is" without warranties of any kind, express or implied. We do not warrant that products will meet your specific expectations regarding color accuracy, as print-on-demand colors may vary slightly from screen displays.

Governing Law

These terms are governed by the laws of the State of Idaho, without regard to conflict of law principles.

Changes

We may update these terms at any time. Continued use of the site constitutes acceptance of the updated terms.
